Get an Apostille in Kentucky for International Document Use

A Kentucky apostille certifies the official signature on a public document for use in another country. The Kentucky Secretary of State issues apostilles and authentications for eligible documents issued in the state. Records issued by another state, a foreign government, or the U.S. federal government must go through the appropriate jurisdiction.

Kentucky Apostille Requirements

Kentucky apostille requirements vary by document type. Paper documents notarized in Kentucky generally require County Clerk certification before submission to the Secretary of State, while public records and electronically notarized documents follow different routes. Here is how the preparation process differs for each category:

  • Private documents. Powers of attorney, consent forms, commercial agreements, and other private papers must first be properly notarized. The County Clerk where the notary is registered must then certify the notary’s signature and commission.
  • Academic and law-enforcement records. To obtain a Kentucky diploma apostille, the school official’s signature generally must be notarized and then certified by the appropriate County Clerk. The same process applies to transcripts. Kentucky criminal background checks follow a similar process for the issuing official’s signature.
  • Electronically notarized documents. Documents notarized by an authorized Kentucky online notary public must be submitted in PDF format through the state’s online portal. County Clerk certification is not required.
  • Vital records. Birth, marriage, divorce, and single-status certificates do not require County Clerk certification. They must be certified copies bearing the signature of the current Kentucky State Registrar.
  • County clerk and court records. Certified copies from a Kentucky county clerk’s office must be signed by the current clerk or a deputy. Circuit or District Court records issued by a Circuit Court Clerk must be submitted to the corresponding county office for certification of that official’s signature.
  • Affidavits of True Copy. When an original cannot be notarized, a sworn and notarized Affidavit of True Copy may sometimes be used. The notary’s signature must also receive County Clerk certification. Because not every destination accepts this method, confirm the requirements with the receiving authority first.

FBI Background Check Apostille Services in Kentucky

An FBI Identity History Summary, commonly known as an FBI background check, is a federal document, so it falls outside the authority of the Kentucky Secretary of State. Kentucky residents may need it apostilled for immigration, foreign residency, employment, visa or citizenship applications, adoption, study abroad, or professional licensing.

For use in a Hague Convention country, a federal apostille for an FBI background check must be obtained from the U.S. Department of State in Washington, D.C. For a non-Hague destination, the document requires federal authentication and may also need embassy or consular legalization. The destination country ultimately determines which process applies.
