How Legal Papers Are Served in Indiana

Indiana Trial Rule 4.1 sets out how an individual may be served, and process servers in Indiana generally work with one of four methods:

  • Registered or certified mail with return receipt requested;
  • Personal delivery of the documents to the individual;
  • Leaving a copy at the individual’s dwelling house or usual place of abode;
  • Delivering a copy to an agent authorized to receive service.

There is an added step for the last two methods. When copies are left at the home or served on an authorized agent, the person making service must also send a copy of the summons and complaint by first-class mail to the person’s last known address, and the return must show that this was done.

Certified mail is often a practical starting point, but it does not always result in completed service. When it is refused, returned unclaimed, or signed in a way that does not establish proper receipt, personal service may be the better option. It also creates a direct record of who was served, when service occurred, and how it was completed.
